Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Spotlight Trivia mobile application (the "App") operated by Spotlight Trivia ("we," "us," or "our").

BY USING THE APP, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE APP.

1. Acceptance of Terms

By creating an account or using the App, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws. If you are under 18, you represent that you have parental/guardian permission to use the App.

2. Eligibility

• You must be at least 13 years old to use the App
• Users aged 13-17 must have parental/guardian consent
• You must provide accurate registration information
• You may not use the App if previously banned

3. Account Registration

3.1 Account Creation

• You may register using Google Sign-In or Apple Sign-In
• You are responsible for maintaining account security
• You must not share your account credentials
• You must notify us immediately of unauthorized access

3.2 Account Termination

• You may delete your account at any time via app settings
• We may suspend or terminate accounts for Terms violations
• Termination results in loss of all credits, purchases, and progress

4. License and Restrictions

4.1 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

4.2 Prohibited Activities

You may NOT:

• Reverse engineer, decompile, or disassemble the App
• Use automated systems (bots, scripts) to access the App
• Exploit bugs or glitches for unfair advantage
• Hack, modify, or tamper with the App
• Use the App for illegal purposes
• Harass, abuse, or harm other users
• Create multiple accounts to circumvent restrictions
• Sell, trade, or transfer your account
• Upload offensive, inappropriate, or copyrighted content

5. Virtual Currency and In-App Purchases

5.1 Credits System

• The App uses virtual currency ("Credits") to access games
• Credits can be earned (daily grants) or purchased
• Credits have no real-world monetary value
• Credits are non-refundable and non-transferable

5.2 In-App Purchases

• All purchases are processed through Apple App Store or Google Play Store
• Purchases are final and non-refundable except as required by law
• We reserve the right to modify pricing at any time
• Promotional offers may have specific terms and expiration dates

5.3 Powerups and Consumables

• Powerups (jokers) are consumable items used during gameplay
• Once used, powerups cannot be restored
• Unused powerups may be lost if your account is terminated

5.4 No Real Money Trading

Buying, selling, or trading accounts or virtual items for real money is strictly prohibited and may result in account termination.

6. Gameplay Rules

6.1 Fair Play

• Play honestly without cheating or exploiting
• Do not collude with other players in multiplayer modes
• Report bugs and exploits rather than abusing them

6.2 Game Modes

• Endless Mode: Solo gameplay with unlimited questions
• Spotlight Mode: Offline multiplayer pass-and-play for 2-8 players
• We may add, modify, or remove game modes at any time

6.3 Leaderboards and Rankings

• Rankings are based on game performance
• We reserve the right to remove fraudulent or suspicious scores
• Leaderboards may reset periodically

7. User Content

7.1 Profile Information

You may provide a display name and profile picture. You retain ownership but grant us a license to use, display, and distribute this content within the App.

7.2 Content Standards

All user content must be:

• Appropriate for all ages (13+)
• Non-offensive and respectful
• Free of copyrighted material (unless you own rights)
• Compliant with applicable laws

7.3 Content Moderation

We reserve the right to remove any content that violates these Terms without notice.

8. Intellectual Property

8.1 Our Rights

All App content, including but not limited to:

• Questions and answers
• Videos and media
• Graphics, logos, and design
• Software code and functionality
• Trademarks and branding

are owned by Spotlight Trivia or our licensors and protected by copyright, trademark, and other intellectual property laws.

8.2 Feedback

If you provide suggestions or feedback about the App, we may use them without obligation or compensation to you.

9. Third-Party Services

The App integrates with third-party services:

• Firebase (Google): Authentication and storage
• Apple/Google: Payment processing
• OpenAI: AI commentary generation

Your use of these services is subject to their respective terms and policies. We are not responsible for third-party services.

10. Disclaimers

10.1 "AS IS" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation

10.2 No Guarantee

We do not guarantee:

• Availability at all times
• Accuracy of questions or content
• Compatibility with all devices
• Security from unauthorized access

10.3 Educational Use

While we strive for accuracy, the App is for entertainment purposes. Do not rely on it as a sole source of factual information.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

11.1 No Liability for Damages

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

• Loss of profits or revenue
• Loss of data or game progress
• Loss of virtual items or currency
• Unauthorized account access

11.2 Maximum Liability

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is less.

11.3 Exceptions

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Spotlight Trivia, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your user content

13. Dispute Resolution

13.1 Informal Resolution

Before filing a legal claim, you agree to contact us at support@spotlight-trivia.com to attempt informal resolution.

13.2 Arbitration (US Users)

Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, rather than in court, except:

• Small claims court matters
• Intellectual property disputes
• Injunctive relief claims

13.3 Class Action Waiver

You agree to resolve disputes individually, not as part of a class action or consolidated proceeding.

13.4 Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

14. Changes to Terms

We may modify these Terms at any time. Changes will be effective when posted with an updated "Last Updated" date. Continued use of the App constitutes acceptance of modified Terms.

For material changes, we will provide notice via:

• In-app notification
• Email (if provided)

If you do not agree to changes, you must stop using the App.

15. Termination

15.1 By You

You may terminate your account at any time by deleting it through app settings.

15.2 By Us

We may suspend or terminate your account immediately, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse or harassment of other users
• Extended account inactivity (2+ years)

15.3 Effect of Termination

Upon termination:

• Your license to use the App ends immediately
• You lose all credits, powerups, achievements, and progress
• We may delete your account data per our Privacy Policy
• Sections that should survive (liability, disputes) remain in effect

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.

16.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

16.3 No Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.

16.4 Assignment

You may not assign these Terms. We may assign them without restriction.

16.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.

17. App Store Terms

17.1 Apple App Store

If downloaded from the Apple App Store, you acknowledge:

• Apple is not responsible for the App or your use
• Apple has no obligation to provide support
• Claims must be directed to us, not Apple
• Apple is a third-party beneficiary of these Terms

17.2 Google Play Store

If downloaded from Google Play, you agree to Google's terms and policies.
